FOR GOOD AND VALUABLE CONSIDERATION, I, the undersigned, hereby grant to SHIFTSETGO, LLC, and its parent companies, affiliates, assigns, licensees, legal representatives, successors-in-interest, advertising, promotion and fulfillment agencies, and their employees and agents, (hereinafter, collectively identified as "SSG") as well as any and all persons or entities that are authorized by SSG to promote and/or sell products and services of SSG (including without limitation all of SSG's international distributors and licensees)(collectively, the "Other Permitted Users"), the irrevocable, unrestricted, absolute and perpetual right throughout the world to use my name (or any fictional name), photograph, appearance, likeness, voice, quotations, comments, endorsements made or other information that I have provided (collectively referred to as my "Likeness"), in connection with promoting the ShiftSetGo weight loss program and related products and services (collectively, the "SSG Program, Products and Services") and any past, present and future materials based upon or derived therefrom in connection with promoting the SSG Program, Products and Services (collectively, the "Material(s)") in any and all forms of media, whether print or electronic, including websites, known or unknown, and to edit or alter the same at its sole discretion and to use and to license others to use in any manner or media whatsoever, including, without limitation, unrestricted use for purposes of publicity, for the SSG Program, Products and Services at any time and throughout the universe, and I waive any right to inspect or approve the finished version(s). I further confirm that SSG may at its sole discretion validate information that I have provided (such as my weight lost while following the ShiftSetGo weight loss program) by consulting with the independent authorized ShiftSetGo clinic with whom I am a member, or by other reasonable means as determined by SSG including, but not limited to reviewing my member account.
I, the undersigned, understand that I shall have no right of approval, no claim to additional compensation or benefit, and no claim (including, without limitation, claims based upon right of privacy, defamation, or right of publicity) arising out of any use or any blurring, distortion, alteration, or use in composite form, whether or not intentional, of my name, photograph, appearance, Likeness and the Materials.
I, the undersigned, hereby release each of SSG and the Other Permitted Users from any and all existing claims or any claims that may subsequently arise, based upon the ownership of and/or use of the above-described Material(s), or use of my name, photograph, appearance and Likeness or any other rights granted to SSG and the Other Permitted Users, including any claims for damages for libel, defamation, infringement of the right of publicity, invasion of privacy, portrayal in a false light, false endorsement, public disclosure of private facts, copyright infringement or unfair competition. I, the undersigned, hereby waive the benefits of any statute or law that purports to limit the effect of this release, and waive the benefit of any provision of law known as "moral rights" or similar laws.
I hereby warrant that I am at least 18 years of age and am competent to sign this Release. I further understand that this is a legal document and I have read this Release and I am fully familiar with and agree with its contents.
